Smoke and carbon monoxide alarms a must for landlords

Subject to Cabinet approval on the 2nd December 2015 Amber Valley Borough Council will be enforcing the new legislation placing specific requirements on landlords to provide smoke detection and carbon monoxide alarms where solid fuel appliances are installed.

The Council is currently consulting on the levels of penalty should landlords not respond to a remedial notice.

Council officers have found that there is some confusion among landlords, but point out that the regulations require that all tenancies shall be provided with smoke alarms from 1st October 2015. Requirements to check that each alarm is in working order at the start of the tenancy only applies to new tenancies that commenced after the 1st October 2015. It does not mean that the requirement to have alarms applies only to new tenancies from 1st October 2015.

Carbon monoxide alarms are required for all rooms where there is a solid fuel burning appliance.

Landlords and agents are advised to read the regulations that set out what their legal obligations are.

Cllr David Taylor, Cabinet Portofolio Holder for Housing and Public Health, says: “Providing alarms is inexpensive and saves lives. With all the publicity around deaths from fires in Derbyshire in recent years landlords should be well aware of the need to provide basic means for tenants to be warned in case of an emergency. The Council hopes that landlords will ensure that their houses have the correct level of protection and that the Council’s officers will not need to take enforcement action. However if complaints are received then action will be taken.”

The Council will continue to work closely with Derbyshire Fire and Rescue Service to promote this important issue.

Derbyshire Fire and Rescue may for a limited time be able to provide free alarms for use in private rented properties. www.derbys-fire.gov.uk
