Arrest after Pentrich fly-tipping

A local man who failed to attend Court to answer a fly-tipping charge was arrested and left with a bill of almost £950.

Matthew Else was arrested on a Warrant for failing to attend Court on 22nd August 2016. He was charged under Section 34 of the Environmental Protection Act 1990 that he neglected his duty of care. The legislation requires that the owner of any waste disposes of it correctly, which Else failed to do.

The fly-tipping, which was investigated by Amber Valley Borough Council officers, occurred on 29 October 2015, at Millstone Lane, Pentrich. The waste consisted of four large black bin bags containing cardboard packaging, food waste, letters and other household waste. Within the waste were a number of letter and address labels containing Matthew Else’s name and address.

Else, of Shirland, said he had moved from his previous address in Morton and therefore did not receive the summons for Court. He admitted he paid someone £70 to clear his waste and that he should have taken more steps to check where the waste was going.

He was fined £203.00, ordered to pay £723.00 costs and a Victim Surcharge of £20.00 in total he is required to pay to the Court £946.00.
