Council maintains its firm approach to fly tipping

Amber Valley Borough Council has once again shown that it will pursue and prosecute persons responsible for fly tipping.

On 31 October, Christopher Curzon-Pollard of Codnor, Derbyshire was prosecuted for failing in his duty to ensure that waste from his business was disposed of properly. He was fined £350 and ordered to pay costs of £723 (including clean-up costs) and a victim surcharge of £35. In total he was required to pay £1,108.

The Council’s investigation started in February 2016 when approximately 3 quarters of a tonne of waste was discovered fly tipped on Sandy Lane, Coxbench, Derbyshire. The waste, which consisted of mainly car parts, was traced back to BSC Limited of 33 Kirkby Road, Sutton in Ashfield, a company run by Mr Curzon-Pollard. Mr Curzon-Pollard was given numerous opportunities to make contact with the Council and assist with the investigation, but he failed.

At court on 31 October, Mr Curzon-Pollard entered a guilty plea, accepting his responsibility for the offence. He stated that he should have taken the relevant details of the person who was taking his waste to ensure they were lawfully able to collect it.

The District Judge, when sentencing, stated that Mr Curzon-Pollard turned a blind eye, and that he should have checked the details of the person who collected the waste.

It costs the Council hundreds of thousands of pounds of tax payers’ money to clear fly tipped waste. The Council takes fly-tipping very seriously. In 2015 the Council attended 320 fly-tipping incidents – almost one for every working day of the year.
