Amber Valley Brownfield Land Register 2017

Amber Valley Borough Council is required to prepare, maintain and publish a register of previously development (Brownfield) land within the Borough which they consider appropriate for residential development. 

The Town and Country Planning (Brownfield Land Register) Regulations 2017 sets out criteria which Local Authories should follow in preparing and publishing their registers.

For sites to be included on the register they must be categorised as previously developed land as defined by the Government in Annex 2 of the National Planning Policy Framework and that are considered by the Council to be suitable, available and achievable for residential development.

Definitions of suitable, available and achievable are provided within the Regulations. 

The register must be published in two parts:-

  • Part 1 - should include the sites and land which is appropriate for residential development as defined above; and
  • Part 2 - will comprise only those sites in Part 1 that the Borough Council has decided are suitable for a grant of permission in principle for residential development.
