Homelessness and housing advice

We offer support and help whether you're homeless or worried about becoming homeless. We'll give you advice based on your personal circumstances.  

We work with numerous partners to provide services to help you stay in your current home. If however that's not possible we can help you to find a new home.

Homelessness and homeless prevention

If you are homeless or threatened with homelessness we have a legal obligation to assess what duty we owe you.

A person is threatened with homelessness if they: 

  • are likely to become homeless in 56 days
  • have received a valid notice to quit (S21 notice) 
  • have received a notice that landlord requires possession of accommodation (NOSP) which expires within 56 days. 

If you're threatened with homelessness and are eligible for help, we can help to prevent your homelessness. 

A person could be homeless if they:

  • have no home in the UK or elsewhere that they have a legal right to occupy
  • have a movable home such as a boat or caravan and there is nowhere it can be placed lawfully
  • you're at risk from harm if you stay in your current home

If you think you may be homeless or threatened with homelessness we may be able to help you to remain in your home or move to another home. The earlier you contact us the more we'll be able to help you.  

If you're homeless we'll look at whether you have local connections in the area such as: 

  • how long you've lived in the area
  • if you're employed in the area
  • you've close family in the area
  • other special circumstances

We'll talk to you about your circumstances. This will help us to understand your situation and any support and help you may need. We'll fill in a personal housing support plan and agree with you what you need to do and also what we need to do to help you. Over the course of your application we'll keep you up to date with what we are doing to help you. You'll also need to make sure you get in touch with us regularly to let us know what you've done from your personal housing support plan.

If you or someone you know is suffering from domestic abuse, there is help available.

Domestic abuse includes any incident of threatening behaviour, violence or abuse. The abuse can be psychological, physical, social, financial, or emotional. Domestic abuse can happen between two people who are or were intimate partners or family members, regardless of their gender or sexuality

If you are in fear of a partner, ex-partner or member of your family, you might be experiencing domestic abuse. Does your partner or a member of your family often:

  • Call you names and make you feel bad about yourself?
  • Make you afraid by threatening you or your children?
  • Behave violently towards you?
  • Stop you seeing your friends or family?
  • Keep you without money?
  • Harm you or make you feel you could be seriously harmed?

If the answer to some of these questions is yes, you might be experiencing domestic abuse.

If you are in a same-sex relationship you can call the National LGBT Domestic Violence Helpline (galop) on 0800 999 5428.

Call Derbyshire Domestic Abuse Support Line on 0800 198 668 or contact by email at derbyshiredahelpline@actionorg.uk.

Call the police on 999:

  • If your personal safety is threatened
  • If you are at risk of assault or injury
  • In an emergency

You may qualify for help from Amber Valley Borough Council if you are a former member of the armed forces and are homeless or threatened with homelessness. We will assess if you are eligible for housing assistance and have not made yourself intentionally homeless.

Subject to you satisfying the above criteria we can help you with both emergency and longer-term accommodation.

Contact us as soon as possible if you think you may be homeless after discharge from the services. We do not need to wait until you are made homeless before we can help.

In addition to the help mentioned above there is a range of services for ex-services people who find themselves homeless and on the streets, for example:

  • The Royal British Legion might be able to help with a rent deposit contact www.support.britishlegion.org.uk or call 0808 802 8080.
  • SSAFA provide housing advice to people currently serving in the forces and ex services personnel and their families. SSAFA can be contacted through www.ssafa.org.uk or on 0800 731 4880.

If you're in hospital and will be unable to return home because of your ill health it may be possible for your home to be adapted to help you to stay there. Please see our disabled facilities grants page.

If you have no place to return to when you're discharged from hospital, housing solutions can assess your housing and support needs and work with you, and any professionals, to ensure accommodation is available for you when you are well enough to leave hospital.

It's important to make contact as soon as possible to allow time for assessments to be completed and accommodation to be identified.

If you're in prison or youth detention and will have no home on release, we can assess your needs and will work with you and any professionals helping you to find a home.

We can offer advice on a range of issues. It's important for you to get in touch as soon as possible to give time for an assessment so that housing solutions can be explored and accommodation found.

If you need housing advice assistance and support with your housing needs, please speak to your health worker, support worker or contact our housing solutions team.

On the basis that you are suffering from a mental illness or impairment this council could well accept that you are vulnerable and therefore in "priority need" for accommodation. This will be determined by your personal circumstances.

The housing solutions team will develop a personal housing plan that will be completed in partnership with you and potentially your advocate to find a sustainable solution to your housing problem. We will also attempt to provide you with access to main stream healthcare services where possible and appropriate.

If you are 16/17 years old or a care leaver, you may be able to get housing and other help from Derbyshire County Council and Amber Valley Borough Council. The help you get mainly depends on your age.

Key advice:

Derbyshire County Council’s Children’s Services team is responsible for finding you somewhere to live until you turn 18. If you are an 18-25 year old homeless care leaver, Amber Valley Borough Council may have a duty to help you if:

  • you have already left care, and
  • you have spent a total of at least 13 weeks in care since the age of 14,
  • and part of that time in care was while you were 16 or 17

Amber Valley Borough Council may have a duty to help you with finding somewhere to live. It doesn't matter if those 13 weeks were not all at the same time.

You have different rights if you have spent less than a total of 13 weeks in care, or you want to leave care before your 16th birthday.

If you are aged 18 to 25, you may be able to get help from both Derbyshire County Council’s children’s services and our housing solutions team. You are automatically classed as being in 'priority need' until your 25th birthday.

Children’s services can also help you by providing support and help with training and education.

If you are in full-time further or higher education, children’s services must find you somewhere to live during holiday periods if you need it.

The duty to refer

The duty to refer requires public authorities in England to notify a local housing authority, such as Amber Valley Borough Council, of service users they think may be homeless or at risk of becoming homeless. Charitable and voluntary groups are also welcome to refer such cases to us.

Please complete the online form below to notify us of such cases, so we can provide the appropriate support to the household.
