Licensing Panel make decision on premises licence for The Bungalow, Denby Village

The Licensing Panel at Amber Valley Borough Council has today granted a premises licence for The Bungalow, Codnor Denby Lane, Denby Village, Derbyshire.

The premises licence approves the provision of licensable activities only, namely live and recorded music; anything of a similar description to live music, recorded music or the performance of dance; and the supply of alcohol.

Speaking after the decision was announced, Peter Carney, Chief Executive at Amber Valley Borough Council said: “This was a finely balanced decision, made following thorough and careful consideration of all the issues involved. Before arriving at its decision the Licensing Panel considered the representations from all interested parties, including the police, local residents and the applicant, to ensure that the application was dealt with in a fair and objective way, in accordance with all appropriate legislation.

The organisers had made it clear that the event would go ahead regardless of the Panel’s decision regarding the sale of alcohol and the provision of regulated entertainment. The Panel has however restricted the hours that these licensed activities can take place, and set out a number of conditions that must be met prior to and during the event.

The Panel noted the close proximity of the proposed site to the adjacent livery yard and has granted the licence only on the condition that the site layout is reorganised so that the main events take place away from the livery premises, thereby reducing the impact on those nearby.

We received no objections from the police on the grounds of crime and disorder and were satisfied that there was insufficient evidence to suggest any disorder was likely to occur.

The Panel expressed concerns that a number of risk assessments requested by the relevant authorities hadn’t been prepared, and those that had were not fully satisfactory. In order to safeguard the safety of those attending the event the applicant has been requested to submit these documents to the Council by the end of the week.

The Council will be carrying out a site inspection prior to the event to establish that all the outstanding issues have been addressed. If any issues remain unresolved following this inspection the Council has the power to revoke the premises licence.”

The applicant and anyone who made relevant representations can appeal against this decision to the magistrates’ court within 21 days.
