The Local Land Charge Act 1975 and the Local Land Charges Rules 1977 gives any person the right to search the Local Land Charges Register upon payment of the prescribed fee.
A search of the Local Land Charges Register enables a prospective buyer to establish whether there are any binding restrictions or outstanding notices that will prohibit the use to which the land or property can be put. A search of the Local Land Charges Register can be conducted either in person or by the submission of a written request on the form LLC 1, published by the Law Society, either by post or electronically through one of the channels supporting the NLIS hub.
The local Land Charges Register was created by statute and contains charges that are binding on successive owners of land. The charges themselves are either expressly created by statute or are restrictions or prohibitions, as defined within the Local Land Charges Act or Rules, on a parcel of land to secure the payment of a sum of money or to limit the use to which the land can be put .
In addition to conducting a search of the Local Land Charges Register a prospective buyer can submit an enquiries form, Con 29, approved by the Law Society to elicit further information relevant to the property held by the authority,
