Following the Referendum on the 20th October 2016, as the number of votes cast in favour of a 'Yes' did not constitute more than half of those voting (i.e. 50% plus 1), the Swanwick Neighbourhood Plan will not be 'made'.

Swanwick Neighbourhood Plan Referendum

Information Statement

A Neighbourhood Planning Referendum will be held for the Swanwick Neighbourhood Plan on 20 October 2016. The question asked in the Referendum will be:

'Do you want Amber Valley Borough Council to use the Neighbourhood Plan for Swanwick to help it decide planning applications in the neighbourhood area?'

The Referendum Area is identical to the area that has been designated as the Swanwick Neighbourhood Plan Area which covers the parish of Swanwick. A map of the Referendum Area can be viewed by clicking here.

You are entitled to vote in the Referendum if on 20 October 2016:

  • You are registered to vote in local elections;
  • The address at which you are registered to vote in a local election, as shown in the register of electors, is in the Referendum Area (assuming that you are entitled to be registered at this address); and
  • You are 18 years of age or over on the day of poll


The Referendum expenses limit that will apply in relation to this Referendum is £2616.88. The number of persons entitled to vote in the Referendum by reference to which the limit has been calculated is: Swanwick = 4320 as at 9 September 2016. 

The Referendum will be conducted in accordance with procedures which are similar to those used at local government elections.

Swanwick Neighbourhood Plan Examination

The Examination of the Swanwick Neighbourhood Plan was completed on 25 April 2016  and the examination report was issued to the Borough and Parish Council.

Appointment of Independant Examiner  

Following on from the consultation of the submitted Neighbourhood Plan the Council has now appointed an Independant Examiner to carry out the examination of the Swanwick Neighbourhood Plan.


Submission of Swanwick Neighbourhood Plan to Amber Valley Borough Council

Swanwick Parish Council has produced a Neighbourhood Plan for the parish of Swanwick. It has now submitted the Neighbourhood Plan to Amber Valley Borough Council to make arrangements for publicity and formal consultation for a period of 8 weeks from Wednesday 18 November 2015.

The Neighbourhood Plan area includes the parish of Swanwick.

The Neighbourhood Plan includes policies against which future development proposals would be assessed through the planning process.

You may also request to be notified of the decision of Amber Valley Borough Council on the Plan in your submission.

All comments received will then be forwarded to the Independant person appointed to carry out an examination of the Neighbourhood Plan.

Swanwick Parish Council hereby gives notice that the statutory period of consultation on Swanwick Parish Neighbourhood Plan Pre-submission document commences on 26th March 2015.

Copies of the full plan, executive summary and the response questionnaire can be downloaded from www.swanwickparishcouncil.org.uk.

Swanwick Neighbourhood Area Application


The Designation of the Parish of Swanwick as a Neighbourhood Area was agreed on 23 May 2013.  

Amber Valley Borough Council has received and application from Swanwick Parish Council under Regulation 5 of the Neighbourhood Planning (General) Regulations 2012 for the Borough Council to designate the area comprising of the Parish of Swanwick as a Neighbourhood Area within the meaning of Section 61G of the Town and Country Planning Act 1990 (as amended by the Localism Act 2011).
