In July 2024, the Amber Valley Borough Local Plan 2022-2040 was submitted to the Secretary of State for examination. Public hearing sessions were held in December 2024, led by Inspectors appointed by the Planning Inspectorate (PINS) on behalf of the Secretary of State.
Earlier this year following the hearing sessions, the council received a letter detailing the Inspectors initial findings and confirming the next steps in relation to the examination. A programme of additional works has now been undertaken and Main Modifications identified. Main Modifications are changes to the Submission Local Plan which are necessary to make it sound and legally compliant and are put forward without prejudice to the Inspectors final conclusions.
The borough council is now undertaking a six-week consultation on the Proposed Main Modifications to the Local Plan which will end at 4:30pm on Friday 5 September 2025.
This consultation focuses specifically on the following documents.
In line with the examination process only representations on these documents should be made and not the Local Plan as a whole. Any comments made during previous Local Plan consultations have already been considered by the Inspectors and should not be resubmitted.

Additional Modifications are minor changes the council would like to make to the Plan, such as formatting or typographical errors which are not necessary to make the Local Plan sound or legally compliant, are not consulted upon. The council has prepared a Schedule of Proposed Additional Modifications which is available to view below, however please note this is for information only.
The council has also prepared a tracked changes version of the Submission Local Plan to assist in understanding where the Main Modifications and Additional Modifications have been proposed and a revised version of the Policies Maps. These documents are available to view below, however please note these documents have been produced for information purposes only and are not being consulted on.
