Ripley Neighbourhood Plan

The Ripley Neighbourhood Plan has been prepared by the Ripley Neighbourhood Plan Steering Group on behalf of Ripley Town Council and formally made by Amber Valley Borough Council.

The Neighbourhood Area covers the whole of the parish of Ripley and it sets out planning policies for this area from 2014-2028. The Ripley Neighbourhood Plan forms part of the Development Plan for the area and will be used through the planning process to assess future development proposals.

Mr Nigel McGurk MCD, MBA, MRTPI has been appointed as Independent Examiner to undertake the examination of the Ripley Neighbourhood Plan (as Proposed to be Modified). The examination has now commenced, and the Independent Examiner has issued the following two letters.

Ripley Town Council is proposing to modify its neighbourhood plan for Ripley Parish. A consultation was carried out for 6 weeks from Friday 18 August 2023 until 4.30pm on Friday 29 September 2023.

The modified Neighbourhood Plan includes policies against which future development proposals would be assessed through the planning process for the town of Ripley and other settlements within the Parish, including Waingroves, Street Lane, Heage, Upper and Lower Hartshay, Sawmills, Heage, Bullbridge and Ambergate.

Ripley Town Council has submitted a further draft of its Neighbourhood Plan (as proposed to be modified) for a screening determination under The Environmental Assessment of Plans and Programmes Regulations 2004.

A screening opinion has been carried out to determine whether or not the Ripley Neighbourhood Plan as proposed to be modified requires SEA and /or HRA.

A screening determination has been carried out concluding that formal Strategic Environmental Assessment is required but that more detailed Appropriate Assessment is not required.

Ripley Town Council has decided to undertake a review of their Neighbourhood Plan.

A screening opinion has been carried out to determine whether or not the Ripley Neighbourhood Plan as proposed to be modified requires SEA and /or HRA.

A screening determination has been carried out concluding that formal Strategic Environmental Assessment is required.

Following the result of the referendum on the 15 October 2015, the Ripley Neighbourhood Plan was formally ‘made’ by the council on the 18 November 2015.

The referendum for the Ripley Neighbourhood Plan took place on the 15 October 2015.

90% of those that voted in the referendum voted ‘yes’.

Following the results, a report was considered by the borough council’s cabinet on the 18 November 2015 recommending that the Neighbourhood Plan be formally 'made'.

The 'specified documents' (which include the draft Neighbourhood Plan) along with other documents outlining the referendum process are listed below.

Under Regulation 18 of The Neighbourhood Planning (General) Regulations 2012, the borough council is required to publish a decision statement following the examination of a Neighbourhood Plan setting out the nature of the changes made to the plan.

The examination of the Ripley Neighbourhood Plan was completed on 19 January 2015 and the examination report was issued to the borough and town council.

Nigel McGurk was appointed as the Independent Examiner in November 2014 to undertake the examination of the Ripley Neighbourhood Plan.

Ripley Town Council submitted the Neighbourhood Plan to Amber Valley Borough Council to make arrangements for publicity and formal consultation for a period of 6 weeks from from 10 September 2014 to 22 October 2014. This consultation has now ended.

All comments received were forwarded to the Independent Examiner appointed to carry out the examination of the Neighbourhood Plan.

*Please note that all submitted comments will be used in the plan process for the lifetime of the Neighbourhood Plan in accordance with the Data Protection Act 2018. Responses cannot be treated as confidential as they may be available for public inspection.

A screening opinion was carried out to determine whether the submitted Ripley Neighbourhood Plan would require a SEA or HRA. It was concluded that these would not be required.

Ripley Town Council consulted on their draft Neighbourhood Plan under Regulation 14 of The Town and Country Planning, England The Neighbourhood Planning (General) Regulations 2012. This consultation period finished on 1 May 2017.

The designation of the Parish of Ripley as a Neighbourhood Area was agreed on 4 March 2013.
