Statement of Principles: Notice of Publication Gambling Act 2005

Introduction

Under the provisions of the 2005 Gambling Act Amber Valley Borough Council is required to produce a Statement of Principles, which sets out how we intend to administer the Act; this Statement lasts for a maximum of three years.

The existing policy has been in force since May 2022. Following an update to the Codes of Practice from the Gambling Commission the Statement of Principles requires updating. This is being incorporated into the natural three-yearly Policy review. This will take effect from 22 May 2025 (when the new three-year cycle begins).

The following revisions have been made into the existing statement:

Part A: General

  • Borough census information – Update to Section 2 (introduction) detailing the latest census information published by The Office for National Statistics between Summer 2022 and Summer 2023

Part B: Premises Licences

  • Section 1 – Update to second Note Box to include the definitions of ‘Children’ and ‘Young Persons’ under the Act
  • Responsibility to third parties – Within Section 1, the addition of a new paragraph from the updated Codes of Practice
  • Combating problem gambling – Also within Section 1, the addition of a new paragraph from the updated Codes of Practice
  • Sections 3, 4, 6 and 7 – Inclusion of a sentence in each section referencing the updated Codes of Practice
  • Section 10 provisional statements – Minor updates to wording to include reference to plans on application, and the terms under which an Authority can refuse a licence (point C)


Consultation

The consultation was open for 8 weeks from 16 September 2024, closing on 11 November 2024.

The Statement shall be published by being made available on the council’s website (see below) and will be available for inspection at the following public libraries:  Alfreton, Ripley, Heanor and Belper. The statement shall be also available for inspection at the Council Offices, Market Place, Ripley, Derbyshire, DE5 3BT.
