Adopted Local Plan 2022-2040

The Amber Valley Borough Local Plan 2022-2040 was adopted on 2 March 2026.

The Amber Valley Borough Local Plan 2022-2040 sets out a vision and a framework for future development in the Borough up to 2040 and includes policies and proposals to address needs and opportunities in relation to housing, the economy, community facilities, and infrastructure, as well to safeguard the environment.

The Amber Valley Borough Local Plan 2022-2040 replaces the 2006 Adopted Amber Valley Borough Local Plan and carries full weight in the consideration of planning applications as part of the development plan for Amber Valley.

In accordance with Regulation 26 and 35 of the 2012 Regulations (as amended), copies of the Adopted Amber Valley Borough Local Plan 2022-2040 (inc. Policies Maps) and following supporting documents are available for inspection below:

Accompanying ‘Additional Modifications’ which are minor changes which do not materially affect the policies in the Local Plan, can be found below:

Following the Public Hearing Sessions held in December 2024, the Council received a letter detailing the Inspectors initial findings and confirming the next steps in relation to the Local Plan examination. A programme of additional works has now been undertaken and Main Modifications identified.

The post-hearings consultation on the Proposed Main Modifications to the Local Plan commenced on Thursday 24 July 2025 and closed on Tuesday 14 October 2025

Amber Valley Borough Council has submitted the Amber Valley Borough Local Plan 2022-2040 to the Secretary of State on 29 July 2024. You can read more on our Local Plan examination page.

Amber Valley Borough Council has prepared a new Local Plan which sets out a vision and a framework for the future development of the borough up to 2040 and includes policies and proposals to address needs and opportunities in relation to housing, the economy, community facilities, and infrastructure, as well to safeguard the environment.

Comments received from partners, stakeholders, and residents during previous consultations have been considered. These comments and recommendations, together with other updated information, have been used to inform the production of the Pre-Submission Local Plan.

Prior to submitting the Local Plan to the Government for examination, a period of consultation commenced at 4:30pm on Friday 16 February 2024 and closed at 4:30pm on Wednesday 1 May 2024 to enable representations to be made on the key aspects that the appointed Inspector will assess during the examination. The key aspects are:

  • Legal compliance – does the Plan meet the legal requirements made under the various statutes?
  • Soundness – has the Plan been positively prepared, justified, effective, and consistent with national policy?
  • Meets the duty to cooperate – has the council engaged and worked effectively with neighbouring authorities and statutory bodies?
