Kirk Langley Neighbourhood Plan

The Kirk Langley Neighbourhood Plan has been prepared by Kirk Langley Parish Council and formally made by Amber Valley Borough Council.

The Neighbourhood Area covers the whole of the parish of Kirk Langley and it sets out planning policies for this area from 2019 - 2032. The Kirk Langley Neighbourhood Plan forms part of the Development Plan for the area and will be used through the planning process to assess future development proposals.

The Kirk Langley Neighbourhood Plan referendum took place on 6 May 2021.

93% of those who voted in the referendum voted 'yes', view results.

A full decision on the plan will be made in due course.

The 'specified documents' (which include the Neighbourhood Plan) along with other documents outlining the referendum process are listed below.

Under Regulation 18 of the Neighbourhood Planning (General) Regulations 2012 (as amended), the borough council is required to publish a decision statement following the examination of a Neighbourhood Plan setting out the nature of the changes made to the Plan.

The examination of the Kirk Langley Neighbourhood Plan was completed on 10 May 2020 and the examination report has been issued to the borough council.

During the examination of the Kirk Langley Neighbourhood Plan the following correspondence took place between the borough council and the examiner.

Chris Collison BA(Hons) MBA MRTPI MIED MCMI IHBC has now been appointed to undertake the independent examination of the Kirk Langley Neighbourhood Plan.

Following the publication of the submitted Kirk Langley Neighbourhood Plan on 13 December 2019, the borough council formally notified each of the consultation bodies referred to in the consultation statement submitted alongside the Neighbourhood Plan, as required by Regulation 16 (b) of the Neighbourhood Planning (General) Regulations 2012 (as amended).

The notification advised that the Neighbourhood Plan had been received and invited the consultation bodies to make any representations within 6 weeks from the date of notification (7 February 2020) i.e. by 20 March 2020. Any representations received by this date would be forwarded to the independent person to be appointed to carry out an examination of the Neighbourhood Plan, alongside any representations received by 7 February 2020, following publication. This consultation has now ended.

Kirk Langley Parish Council produced a Neighbourhood Plan for the parish of Kirk Langley and submitted it to Amber Valley Borough Council to make the arrangements for publicity and formal consultation for a period of 8 weeks from 13 December 2019. Please note that this was extended from the minimum 6-week requirement under the regulations, given that it extended over the Christmas/New Year period. This consultation has now ended.

The Neighbourhood Plan area includes the parish of Kirk Langley and includes policies against which future development proposals would be assessed through the planning process.

All comments received will be forwarded to an independent person appointed to carry out an examination of the plan.

Representations received during the publicity period: 

A screening opinion has been carried out to determine whether or not the Kirk Langley Neighbourhood Plan requires a SEA or HRA. 

Kirk Langley Parish Council are currently consulting on their draft Neighbourhood Plan under Regulation 14 of The Town and Country Planning, England, The Neighbourhood Planning (General) Regulations 2012. The consultation period runs until 2 November 2019.

The designation of the Parish of Kirk Langley as a Neighbourhood Area was agreed on 7 April 2017.
